Town of Portsmouth Wind Turbine
We successfully litigated a challenge to the Town’s net metering arrangement for its 1.5MW turbine, establishing that a town could remote net meter from a wind turbine to remote town facilities without running afoul of the Federal Energy Regulatory Commission’s avoided cost standard for wholesale transactions. When the original gearbox turbine failed without a viable warranty, we helped the Town recover by negotiating for its replacement in a deal that extinguished the debt on the first turbine and gave them long-term access to clean energy that is net metered at market rates. The Town is back in action with established rights to remote net meter and their own reliable supply of clean, secure and affordable energy.
